Terms of Service — MP Modular

§1. General provisions

These Terms of Service govern the use of the website mpmodular.com.pl, operated by:

hereinafter referred to as "Seller" or "MP Modular".

§2. Definitions

Customer — individual, legal entity or organizational unit using the site and/or placing an order.
Consumer — individual performing a legal act not directly related to their business activity.
Product — modular home, residential container or other object offered by the Seller.
Quote inquiry — contact form or configurator submitted by the Customer to receive a quote.
Contract — written sales contract between Customer and Seller after quote acceptance.

§3. Website scope

mpmodular.com.pl allows you to:

Browse the modular homes and residential containers offer.
Use the online product configurator (10 steps).
Submit a quote inquiry via form.
Book a showroom visit.
Access the blog and educational content.

A quote inquiry does not constitute a sales contract. The contract is concluded in written form after quote acceptance.

§4. Order procedure

Customer submits inquiry via form, configurator or direct contact.
Seller replies within 24 business hours with preliminary quote.
After quote acceptance — Customer receives contract draft and technical specification.
Customer pays 30% deposit of order value — moment of contract signing.
Production begins (6–12 weeks).
Customer pays remaining 70% before delivery.
Transport and installation on Customer's prepared foundation.
Handover protocol — keys transferred.

§5. Prices and payment

All prices on the site are gross (include 23% VAT) and denominated in Polish zloty (PLN). Prices in euro (€) shown in the English version are converted at 4.50 PLN/EUR rate — binding are PLN prices and contract terms.

Payment:

30% deposit upon contract signing — bank transfer.
70% balance before delivery — bank transfer.

Foundation, utility connections and site preparation are the Customer's responsibility and not included in the home price.

§6. Transport and installation

Transport from Gdynia/Reda across Poland is calculated individually based on distance and site accessibility. Transport price is stated in the quote.

The Customer is responsible for:

Obtaining a building permit or notification (if required).
Preparing the foundation per the structural drawing.
Bringing utilities (electricity, water, sewage) to the foundation.
Providing access road for the truck (min. 3.5 m wide) and space for the crane.

§7. Warranty

The Seller grants a 24-month warranty on the product from the handover date. Warranty covers material and workmanship defects.

Warranty does not cover:

Damage caused by improper use or maintenance.
Damage caused by force majeure (flood, storm, fire, lightning).
Natural wear of consumable elements.
Modifications made by the Customer or third parties.

§8. Complaints

Complaints should be sent to artur@mpmodular.com.pl with description of the defect, photo documentation and date of occurrence.

The Seller processes the complaint within 14 days. In justified cases the period may be extended to 30 days.

§9. Withdrawal from contract (Consumer)

Consumer has the right to withdraw from a distance contract within 14 days without giving reason (Art. 27 of the Polish Consumer Rights Act).

Right of withdrawal does not apply to service contracts fully performed with the consumer's express consent, or to products made to the Consumer's specification (modular home custom-manufactured on individual order).

§10. Personal data protection

Personal data processing follows GDPR and is detailed in the Privacy Policy.

§11. Final provisions

In matters not covered here, Polish law applies, in particular:

Polish Civil Code.
Consumer Rights Act of May 30, 2014.
Act on providing electronic services of July 18, 2002.
GDPR (Regulation 2016/679).

Court competent for disputes is the court for the Seller's registered office. Consumers may also use out-of-court dispute resolution (ODR platform: ec.europa.eu/consumers/odr).
